Judge Certifies Class In FLSA Action Against Dow

Law360, New York (May 28, 2008, 12:00 AM EDT) -- A district court has conditionally certified a class of current and former Dow Chemical Co. employees in a suit alleging the plastics and chemicals manufacturer failed to pay overtime to workers who took part in a job-related training program.

Judge Lee H. Rosenthal of the U.S. District Court for the Southern District of Texas authorized the class Wednesday, but defined it more narrowly than the named plaintiff, Roy Maynor, had proposed.
