AARP Asks 7th Circ. To Reconsider Nursing Home FCA Suit

Law360, New York (September 11, 2014, 7:17 PM EDT) -- The AARP filed an amicus brief on Wednesday in support of an appeal of the Seventh Circuit’s decision to erase a $9 million verdict tied to alleged nursing home neglect, saying the ruling threatens to gut whistleblower protections under the False Claims Act.

The AARP and four other groups submitted the brief backing two whistleblower nurses who asked the Seventh Circuit last week to restore a jury verdict against Momence Meadows Nursing Center, saying the appeals panel’s ruling could encourage retaliation against whistleblowers and invite nursing homes to destroy evidence of patient mistreatment, according to the brief.
