Court Rules Appeal Of Arriva Bankruptcy Plan Moot

Law360, New York (May 30, 2008, 12:00 AM EDT) -- A Florida pharmaceutical company has lost its bid opposing the Chapter 11 reorganization plan of rival Arriva Pharmaceuticals Inc. in a case that stems from a long-running patent battle between the two firms over a drug for emphysema.

U.S. District Judge Susan Illston issued an order Tuesday in the Northern District of California dismissing AlphaMed Pharmaceuticals Corp.'s appeal as moot.

While AlphaMed had appealed the bankruptcy court approval of Arriva's reorganization plan, it did not seek a stay of the confirmation plan before it was approved,...
