'Patent Trolls' Can Boost Competition: Experts

Law360, New York (June 5, 2008, 12:00 AM EDT) -- Nonpracticing patent holders have come under increasing scrutiny by courts and antitrust agencies for excluding potential competitors from the product market and extracting exorbitant royalty fees from producers, but experts contend that certain nonpracticing entities promote competition.

As the U.S. Supreme Court’s eBay Inc. decision makes it harder for patent holders to obtain injunctive relief, and the Federal Trade Commission vows to examine the conduct of nonpracticing entities more closely, experts are growing concerned that some entities are being unfairly targeted as patent trolls.
