Wyeth Sues Again Over Protonix Patent

Law360, New York (June 13, 2008, 12:00 AM EDT) -- Wyeth and Nycomed GmbH have filed a patent lawsuit seeking to stop Teva Pharmaceutical Industries Ltd. from marketing a copycat version of the injectable heartburn treatment Protonix.

The suit, filed June 11 in the U.S. District Court for the District of New Jersey, is similar to a pair of cases brought earlier this year against Sandoz Inc. and Apotex Inc.

The complaint alleges that Israel-based Teva and two of its subsidiaries infringed a patent covering Protonix IV. Nycomed owns the patent, U.S. Patent No. 4,758,579, which...
