Carrabba's Italian Grill Hit With OT Class Action

Law360, New York (November 19, 2014, 8:48 PM EST) -- Restaurant chain Carrabba's Italian Grill required its cooks to work off the clock and did not pay required overtime wages, a proposed class action filed in a Florida federal court on Tuesday alleges.

Plaintiff Danny Batista alleges that OS Restaurant Services Inc., a Florida company doing business as Carrabba's Italian Grill, didn't pay him time and a half for hours worked past 40 per week in violation of the Fair Labor Standards Act.

"No provisions were made by [the company] to properly pay for those hours" and the company has a "policy or practice of requiring its cooks to work off...
