Boiron Colluded On Deal Over Flu Remedies, 9th Circ. Told

Law360, Los Angeles (December 11, 2014, 6:52 PM EST) -- Boiron Inc.'s $5 million deal to end claims it falsely advertised the effectiveness of its homeopathic flu remedies shouldn't have been approved, a class member told the Ninth Circuit on Thursday, saying Boiron colluded with plaintiffs to widen the scope of the deal and doom other pending class actions.

"Your honors, this is a classic example of a collusive reverse-auction," the objector's attorney, Richard Hikida of Newport Trial Group APC, told a three-judge panel in Pasadena, California. "The release was way overbroad. ... It's astounding in terms of its breadth."
