ICT Loses Summary Judgment Bid In Sealer Case

Law360, New York (June 27, 2008, 12:00 AM EDT) -- A judge has ruled that plaintiffs in product liability litigation over Stand 'N Seal grout sealer can use circumstantial evidence to show that they were exposed to a toxic ingredient in the sealer, denying a motion for summary judgment by Innovative Chemical Technologies Inc.

ICT manufactured a chemical known as Flexipel S-22WS, which was introduced into Stand 'N Seal in April 2005. The product, sold exclusively by Home Depot Inc., was originally made with a different ingredient, Zonyl, instead of Flexipel.
