Georgia Court Denies Air Permit For Coal Plant

Law360, New York (June 30, 2008, 12:00 AM EDT) -- A proposed coal-fueled generating plant in Georgia, the first in more than two decades, was stalled on Monday after a county judge refused to grant energy company Dynergy an air-pollution permit for the project.

Judge Thelma Wyatt Cummings Moore of the Fulton County Superior Court in Georgia halted construction on the $2 billion plant, finding that the state's Environmental Protection Division should have taken into account the amount of carbon dioxide emissions from the plant.
