Firm Wants Higher Contingency Fee In Guidant MDL

Law360, New York (July 14, 2008, 12:00 AM EDT) -- A plaintiffs' law firm involved in the settled multidistrict litigation over Guidant Corp.'s implantable heart defibrillators has objected to a recommendation by special masters that its contingency fees be set at 25%, arguing that they should be raised to 33.3%.

In deciding to up the contingency fees from 20% to 25%, the special masters made an accurate assessment of the attorneys' experience, the difficulty they confronted and the novelty required to litigate the case, but they did not take into account the fact that different firms...
