Judge Lets Some Claims Proceed In Mine Case

Law360, New York (August 7, 2008, 12:00 AM EDT) -- A federal judge has allowed part of a proposed collective action against an Illinois coal mining company to go forward even though the U.S. Department of Labor has filed a lawsuit that duplicates some claims.

Judge G. Patrick Murphy of the U.S. District Court for the Southern District of Illinois ruled Monday that claims that go back three years can stay in the suit because the DOL suit only involves claims that stretch back two years.
