Fla. Judge Vets Class Cert. Args In Wells Fargo Overdraft MDL

By Nathan Hale (May 12, 2015, 8:02 PM EDT) -- The Florida federal judge handling multidistrict litigation on allegedly deceptive bank overdraft fees said Tuesday it will be several weeks before he decides on class certification in five underlying cases, but if his comments revealed any leanings, they hewed more closely to the plaintiffs' arguments.

During the second day of oral arguments in Miami between the plaintiffs' counsel and Wells Fargo Bank NA, U.S. District Judge James Lawrence King stressed that his questions — mostly for the defense — were not meant to be argumentative, but he again expressed concerns with the bank's focusing on the complexity of the plaintiffs' proposed...
