Tiffany Appeals In Effort To Force EBay To Police Site

Law360 (August 12, 2008, 12:00 AM EDT) -- Tiffany & Co. has challenged a federal court's decision to let eBay Inc. off the hook in a trademark infringement case alleging the online auctioneer did not take enough steps to prevent counterfeit Tiffany jewelry from being sold on its site.

Tiffany asked the U.S. Court of Appeals for the Second Circuit on Monday to weigh in on the the U.S. District Court for the Southern District of New York's July 14 ruling that found eBay did not have to police its site to identify and remove fake jewelry sold under Tiffany's trademark.
