Judge Tosses ERISA Claims Against EDS

Law360, New York (August 13, 2008, 12:00 AM EDT) -- A federal judge has dismissed claims of Employee Retirement Income Security Act violations in a collective action suit against Electronic Data Systems Corp., but the plaintiffs' claims for overtime compensation under the Fair Labor Standards Act still stand.

In an order handed down Tuesday, a judge in the U.S. District Court for the Eastern District of Michigan dismissed the plaintiffs' ERISA charges for “failing to state a claim upon which relief can be granted.”
