Full Fed. Circ. Won't Review Sidley Blown-Deadline Ruling
By Jacob Fischler (June 16, 2015, 5:04 PM EDT) -- The Federal Circuit said on Monday it will not rehear AT&T Inc.'s request to be allowed to appeal a $40 million patent infringement verdict after the company's attorneys at Sidley Austin LLP missed the deadline for filing the appeal.
The circuit judges rejected without comment AT&T's request for en banc review of a 2-1 March decision that, despite "admittedly inaccurate" information from a Texas federal court, the company cannot appeal the patent infringement verdict because its attorneys should have more closely monitored the electronic docket.
