EchoStar Lashes Out At Antitrust Cross-Claim

Law360, New York (August 26, 2008, 12:00 AM EDT) -- Satellite-TV broadcaster EchoStar Communications Corp. contends that its lawsuit accusing a set-top box distributor of developing and distributing technology that pirates EchoStar’s signals does not constitute “sham” litigation in violation of antitrust laws.

Englewood, Colo.-based EchoStar found itself on the defensive Tuesday, battling a counterclaim by Viewtech Inc. that the copyright suit filed in the U.S. District Court for the Southern District of California, and similar suits against Viewtech competitors, are an attempt to force out rivals from the free-to-air receiver market.
