9th Circ. Revives Western Filter’s Contract Dispute

Law360, New York (August 27, 2008, 12:00 AM EDT) -- A federal appeals court has refused to uphold a time limit in a stock purchase agreement between Western Filter Corp. and Argan Inc., finding that the provision does not clearly state the parties’ intent to reduce a longer statute of limitations provided by California law.

Monday’s decision by the U.S. Court of Appeals for the 9th Circuit revives Western Filter’s suit after a lower court granted Argan summary judgment in the contract dispute.
