Amazon Must Face TM Suit Over Search Results, 9th Circ. Says

Law360, Los Angeles (July 6, 2015, 3:45 PM EDT) -- Amazon.com Inc. must face a Los Angeles watchmaker’s trademark infringement suit over allegedly misleading search results, the Ninth Circuit ruled Monday, holding that Amazon could be misleading consumers by not clearly stating that it doesn’t carry the watchmaker’s products.

Multi Time Machine Inc., a maker of military-style watches, says the online retail behemoth violated its trademarks by showing consumers watches made by rival brand Luminox when they searched for the trademark-protected brand name of MTM, whose watches Amazon does not carry. A district judge had dismissed the suit, saying MTM failed to show that the search results confused consumers.
