Ohio Lead Paint Suit Belongs In State Court: Judge

Law360, New York (September 2, 2008, 12:00 AM EDT) -- A lawsuit by the state of Ohio accusing lead paint manufacturers and distributors of creating a public nuisance in the state has no business in federal court, a magistrate judge has ruled, recommending that the matter be remanded to state court where it was originally filed.

On Thursday, Magistrate Judge Norah McCann King said that the matter, originally lodged in the Court of Common Pleas for Franklin County in Ohio in 2007, was improperly removed to federal court by defendant Atlantic Richfield Co.
