BorgWarner Beats $32.5M Asbestos Punitives Award In Appeal
By Dani Meyer (July 16, 2015, 6:25 PM EDT) -- A California state appellate court Wednesday overturned a $32.5 million punitive damages award against auto parts supplier BorgWarner Morse Tec Inc. in an asbestos exposure suit, but said the company must still pay its share of $6 million in noneconomic damages.
The unanimous three-judge panel said former General Motors Co. security guard Secundino Medina's family's evidence about BorgWarner's revenue wasn't enough to show whether it would be able to pay the $32.5 million damages award without bankrupting the company.
