Apple Trade Secrets Case Raises First Amendment Issues

Law360, New York (June 2, 2006, 12:00 AM EDT) -- In a blow to Apple Computer Inc., a California appeals court has struck down a request to force the publishers of two Apple enthusiast Web sites to reveal the sources of leaked trade secret information published in a series of stories in late 2004.

Some intellectual property practitioners say the ruling could thwart the ability of trade secret owners to protect proprietary and confidential information, but others say it constitutes move to protect the rights of online journalists to protect the confidentiality of their sources....
