2 States Lose Class Cert. Bid In DRAM Antitrust Suit

Law360, New York (September 7, 2008, 12:00 AM EDT) -- A federal judge has shot down a class certification bid by a group of government entities in California and New Mexico whose case is part of the multidistrict litigation against a slew of manufacturers over an alleged price-fixing conspiracy in the U.S. market for dynamic random access memory.

Judge Phyllis J. Hamilton of the U.S. District Court for the Northern District of California denied the plaintiffs' motion Friday, ruling that the proposed government entity classes were too divergent in size and scope.
