9th Circ. Revives Ray Charles Foundation Copyright Suit

Law360, Los Angeles (July 31, 2015, 8:02 PM EDT) -- The Ninth Circuit on Friday reversed a lower court's dismissal of a suit brought by the Ray Charles Foundation challenging the late singer's heirs' attempt to reclaim copyrights for dozens of songs, ruling that the foundation had standing since it receives royalties from the copyrights held by Warner/Chappell Music.

A three-judge panel said the nonprofit foundation, which is the sole beneficiary of Ray Charles' estate, has standing to challenge the validity of termination notices the heirs issued to Warner and various individuals for more than 50 Ray Charles songs.
