Alcatel-Lucent Can't Ax Acacia Unit's Communications Patent

By Jimmy Hoover (August 10, 2015, 9:18 PM EDT) -- A unit of patent holding company Acacia Research Corp. cleared a major hurdle Friday in its infringement suit against Alcatel-Lucent USA Inc. over a data communication patent, when a California federal judge upheld the patent's validity.

In a decision granting Labyrinth Optical Technologies LLC's motion for summary judgment of no invalidity, U.S. District Judge Andrew J. Guilford shelved Alcatel-Lucent's argument that the patent was obvious in light of prior art.

The French telecom giant had argued that the patent did not claim anything new beyond the combination of two previously patented technologies from 1990 and 1992.
