Ill. CON Laws Threaten Competition: DOJ, FTC

Law360, New York (September 12, 2008, 12:00 AM EDT) -- The U.S. Department of Justice and the Federal Trade Commission on Friday issued a joint statement decrying Illinois' certificate-of-need laws as threats to innovation, consumer choice and the control of health care costs.

The DOJ and FTC addressed the statement to the Illinois Task Force on Health Planning Reform, as part of the agencies' campaign to keep U.S. health care competitive.

Certificates-of-need, or CONs, are granted by the government to allow the expansion of facilities to meet unmet needs. DOJ and FTC argue that CON laws...
