USCIS Must Give Up H-1B Visa Docs, 7th Circ. Finds

Law360, New York (September 1, 2015, 2:23 PM EDT) -- The Seventh Circuit on Monday ruled against U.S. Citizenship and Immigration Services in a Freedom of Information Act dispute with a retired immigration attorney, finding the agency's search for records on the H-1B visa program was inadequate.

In a published opinion, a three judge panel for the appeals court overturned a lower court's decision and ordered USCIS to conduct a search responsive to David Rubman's 2012 request. Rubman, who had asked for all documents reflecting statistics on H-1B visa applications since 2009, sued the agency in federal court after it refused to release more than a single table of statistics....
