Cymbalta Plaintiffs To Appeal To 9th Circ. After Trial Losses

Law360, New York (September 8, 2015, 5:24 PM EDT) -- Two plaintiffs have said they intend to appeal verdicts in favor of Eli Lilly & Co. to the Ninth Circuit after losing their respective trials last month over the withdrawal effects of the antidepressant Cymbalta, which they claimed the drugmaker downplayed.

Plaintiffs Erin Hexum and Claudia Herrera filed notices of appeal after losing their trials against the pharmaceutical company in August. On Aug. 7, a California federal jury rejected Herrara’s claims that Eli Lilly hid the withdrawal risks of Cymbalta, finding the drugmaker did not mislabel the drug and was not liable for the woman's purported withdrawal symptoms.
