Hernia Patch Defense Can't Hire Plaintiffs' Docs: Judge

Law360, New York (September 22, 2008, 12:00 AM EDT) -- Defense counsel for C.R. Bard Inc. won't be able to retain medical experts who are treating any of the plaintiffs involved in a multidistrict product liability case over an allegedly defective hernia mesh patch, a federal judge has ruled.

Magistrate Judge Lincoln Almond of the U.S. District Court for the District of Rhode Island on Friday expanded on an earlier order prohibiting defense counsel from speaking off the record with plaintiffs' treating physicians, finding that all ex parte communication between them should be banned.
