Army's Shipment Of VX Byproducts Legal: Judge

Law360, New York (September 24, 2008, 12:00 AM EDT) -- A federal judge has denied a bid by environmentalists to stop the U.S. Army from shipping byproducts of the disposal of deadly VX nerve agent from Indiana to Texas for incineration.

Judge Larry McKinney of U.S. District Court for the Southern District of Indiana ruled Monday that the Army had performed adequate environmental tests when it rerouted the shipments of caustic VX hydrolysate, also known as CVXH, from a depot in Newport, Ind., to a facility operated by Veolia Environmental Services Inc. in Port Arthur, Texas....
