Gatorade Owner No Fan Of 'Haterade,' Sues Creator Over TM

Law360, Los Angeles (September 17, 2015, 10:25 PM EDT) -- Stokely-Van Camp Inc., the owner of trademarks for Gatorade sports drinks, on Thursday filed suit in Illinois federal court against the makers of bodybuilding supplement “Haterade,” accusing them of infringing Stokely-Van's marks and harmfully associating Gatorade with the “colloquial, derogatory term 'hater.'”

The suit alleges that Active Sports Distribution and DuraCap Labs LLC, have ignored multiple attempts by Stokely-Van to resolve the situation amicable, and have gone back on a promise to stop selling their product — which not only plays off the Gatorade word mark, but also comes in packaging labeled with an orange lighting bolt.
