Plaintiffs Move To Settle Antitrust Action V. Roche

Law360, New York (September 29, 2008, 12:00 AM EDT) -- Plaintiffs in an antitrust class action have asked a federal judge to approve a $33 million settlement in their lawsuit alleging Hoffmann-La Roche Inc. and others exploited a patent useful in analyzing DNA samples.

According to the motion, filed Friday in the U.S. District Court for the District of Columbia, the proposed settlement amounts to a "significant recovery" — approximately 14 percent of total sales of the products at issue during the class period — and continued litigation could lead to no recovery at all....
