XM Wins Dismissal Of Proposed Class Action

Law360, New York (September 30, 2008, 12:00 AM EDT) -- A federal judge has dismissed a proposed class action brought by XM Satellite Radio Inc. subscribers, who were seeking damages for a 24-hour-period in May 2007 when they lost service.

In an opinion issued Friday, Judge Peter G. Sheridan of the U.S. District Court for the District of New Jersey ruled that XM and its parent holding company, XM Satellite Radio Holdings Inc., were not required to provide an uninterrupted transmission.
