2 Classes Certified In Drug Pricing Suit

Law360, New York (September 30, 2008, 12:00 AM EDT) -- In a blow to AstraZeneca Pharmaceuticals LP and Bristol-Myers Squibb Co., a federal judge has given the green light to two national classes in the multidistrict litigation over average wholesale drug prices, allowing the plaintiffs to pursue their claims of unfair and deceptive trade practices against the two drug giants.

The two certified classes will include the third-party payor Medigap Supplemental Insurance class and the consumer and third-party payor class for Medicare Part B drugs, Judge Patti Saris said in a ruling Friday in the U.S....
