Sears Not Entirely Off Hook In Washing Machine Suit

Law360, New York (October 1, 2008, 12:00 AM EDT) -- Despite dismissing claims of fraud and unjust enrichment in a proposed class action against Sears Roebuck & Co. alleging the retail giant sold defective Kenmore washing machines, a federal judge has ruled that consumers can proceed with an implied warranty claim against the company.
