States Sue EPA Over Clean Water Act 'Loophole'

Law360 (October 2, 2008, 12:00 AM EDT) -- Nine states, led by New York State Attorney General Andrew Cuomo, are launching an attack against the U.S. Environmental Protection Agency's "water transfer" rule, which they argue greenlights the transfer of polluted water into clean water sources, Cuomo's office announced Thursday.

Challenging the "National Pollutant Discharge Elimination System Water Transfers Rule," the states and a Canadian province filed the lawsuits earlier this week in both the U.S. District Court for the Southern District of New York and the U.S. Court of Appeals for the Second Circuit....
