Jewelry Channel Gets Rival's Auction Patent Axed Under Alice

Law360, New York (October 20, 2015, 5:10 PM EDT) -- The Patent Trial and Appeal Board has invalidated an auction patent that Jewelry Television had sued rival network, The Jewelry Channel Inc. USA, for infringing, finding the patent claimed only an abstract idea and thus making it invalid under the U.S. Supreme Court's Alice decision.

In a final written decision in an America Invents Act review, the PTAB on Friday held the patent's claims were directed to the underlying, abstract idea of a reverse auction.
