Law360 (October 6, 2008, 12:00 AM EDT) -- Kaiser Foundation Health Plan Inc. has agreed to pay $5.4 million to settle a class action that accused the health care giant of misclassifying around 770 California employees and failing to pay them overtime wages.
U.S. District Judge Irma E. Gonzalez of the U.S. District Court for the Southern District of California granted preliminary approval on Monday to both the class and the proposed settlement. The settlement would put over $3.7 million of the total award directly into the hands of class members.
