Iowa Homeowners Win Class Cert. In Milling Pollution Suit

Law360, New York (October 29, 2015, 4:50 PM EDT) -- An Iowa judge agreed Wednesday to certify a class covering about 4,000 people in a lawsuit accusing Grain Processing Corp. of creating a public nuisance by releasing a stinking haze of smoke with its corn wet milling operations.

Judge Tom Reidel signed off a class covering Muscatine, Iowa, residents living within 1.5 miles of GPC’s facility and rejected the company’s position that class members’ various lifestyle choices, physical ailments, personal preferences and other issues made individual claims more appropriate.
