9th Circ. Affirms McGraw-Hill ERISA Case Dismissal

Law360, New York (October 13, 2008, 12:00 AM EDT) -- A federal appeals court has upheld the dismissal of a putative Employee Retirement Income Securities Act class action against McGraw-Hill Cos. Inc., agreeing with the trial court that the plaintiffs, who worked at McGraw-Hill through a staffing agency, were not eligible for employee benefit plans because they weren't on the company payroll.
