Judge Sinks Boat Damage Case Against Oil Firms

Law360, New York (October 14, 2008, 12:00 AM EDT) -- A federal judge has thrown out a proposed class action against big oil firms, including Exxon Mobil Corp. and ConocoPhillips Co., that alleged their ethanol-blended gasoline caused damage to boat fuel tanks and engines.

Judge Otis D. Wright II of the U.S. District Court for the Central District of California on Tuesday dismissed the case without leave to amend, finding the plaintiff’s product liability claim was in direct conflict with a state and federal law requiring the use of ethanol.
