3rd Circ. Blocks Bid For Rehearing In Vioxx Suit

Law360 (October 20, 2008, 12:00 AM EDT) -- An appeals court has refused a request by Merck & Co. to reconsider its ruling removing barriers to a securities and Employee Retirement Income Security Act class action against the drugmaker related to disclosures Merck made about its blockbuster pain medication Vioxx.

In an order issued Friday, the U.S. Court of Appeals for the Third Circuit denied Merck's petition for rehearing, submitted after the court handed down a ruling against the company in September.

Merck spokesman Ron Rogers said the company is reviewing the decision....
