Antitrust Counterclaim Survives In Flash Memory Suit

Law360, New York (October 21, 2008, 12:00 AM EDT) -- A judge has pared STMicroelectronics Inc.'s counterclaims in a flash memory patent suit brought by SanDisk Corp., dismissing the allegation that SanDisk violated federal antitrust law by bringing sham litigation, but leaving intact ST's “Walker Process” counterclaim.

On Friday, Judge Jeremy Fogel of the U.S. District Court for the Northern District of California signed off on an order granting SanDisk's summary judgment bid with respect to ST's sham litigation counterclaim. Judge Fogel also dismissed ST's state law counterclaims.
