Wells Fargo's Bid To Dismiss Collective Action Nixed

Law360 (October 22, 2008, 12:00 AM EDT) -- A federal judge has rejected Wells Fargo Financial Inc.'s argument that a California court's decision not to certify a nationwide class of about 14,000 people in an overtime suit barred a plaintiff in Ohio from pursuing similar class and collective action claims.

Judge James Gwin of the U.S. District Court for the Northern District of Ohio handed down an 8-page ruling on Monday denying Wells Fargo Financial Inc.'s motion seeking dismissal, or in the alternative, summary judgment.
