Lifewatch Disclaims Telemarketing Scam At Trial With FTC

Law360, Chicago (December 14, 2015, 9:11 PM EST) -- Lifewatch Inc.'s CEO took the stand Monday to urge an Illinois federal judge to not temporarily ban the medical device company from telemarketing its products, saying it has no deceptive intentions and Federal Trade Commission efforts to halt the calls threaten his business.

Evan Sirlin told U.S. District Judge Gary Feinerman that Lifewatch is not attempting to deceive elderly customers by selling them emergency alert systems on phony pretexts. He said that Lifewatch contracts with telemarketers that are expressly prohibited from violating the law and that any telemarketer found to have done so has had its contract revoked.
