Motor Coach Seeks To Shelve Rita Injury Litigation

Law360, New York (October 23, 2008, 12:00 AM EDT) -- Survivors and relatives of victims of a fatal bus fire during the 2005 Hurricane Rita evacuation are battling with Motor Coach Industries International Inc. over whether their litigation against the bankrupt bus maker should be allowed to continue.

In an objection filed Wednesday in the U.S. Bankruptcy Court for the District of Delaware, Motor Coach claimed that lifting the automatic stay in its Chapter 11 proceedings to allow the wrongful death and personal injury claims to proceed would substantially harm the debtors' reorganization efforts.
