Texas Justices To Weigh Subcontractor Liability In Injury Suits

Law360, New York (December 18, 2015, 10:55 PM EST) -- The Texas Supreme Court said Friday it will hear an appeal concerning an apparent conflict between provisions of the Texas Worker’s Compensation Act, in which a subcontractor is arguing it should be statutorily shielded from a negligence suit filed by an injured employee of the general contractor.

The appeal was filed by TIC Energy & Chemical Inc., a construction company hired as a subcontractor by Union Carbide Corp., a Dow Chemical Co. subsidiary.
