Wells Fargo Loses Another Dismissal Bid In FLSA Suit

Law360 (October 31, 2008, 12:00 AM EDT) -- Wells Fargo Financial Inc. has again lost its argument that a California court's decision to deny nationwide class certification to 14,000 people in an overtime suit prevents plaintiffs from pursuing similar claims in another court.

In an order issued Thursday, Magistrate Judge Wallace W. Dixon of the U.S. District Court for the Middle District of North Carolina recommended the company's dismissal motion be denied, finding that the California court had not specifically addressed the class allegations in the North Carolina action.
