Chobani Must Pull Ads About 'Chlorine' In Dannon Yogurt

Law360, New York (January 29, 2016, 6:13 PM EST) -- A New York federal judge told Greek-yogurt purveyor Chobani LLC on Friday to pull the plug on an advertising campaign suggesting yogurt made by its competitor Dannon is sweetened with an ingredient that is part chlorine.

U.S. District Judge David N. Hurd said Dannon Co. Inc. had met all the necessary criteria in its request for a preliminary injunction. Most importantly, Dannon had shown it is likely to succeed in its false advertising claim over the ads suggesting the well-studied and U.S. Food and Drug Administration-approved sweetener sucralose is “bad stuff,” the judge said.
