9th Circ. Denies Dismissal To HBOC Fraud Defendants

Law360 (November 4, 2008, 12:00 AM EST) -- Two former executives of health care software firm HBO & Co. may have to stand a second trial for securities fraud charges related to the company’s 1999 merger with pharmaceutical distributor McKesson Corp., following a recent appeals court ruling.

The U.S. Court of Appeals for the Ninth Circuit affirmed on Friday a ruling in the U.S. District Court for the Northern District of California, denying dismissals of securities fraud charges against former HBOC executives Charles W. McCall and Jay M. Lapine.
