DOJ, State AGs Investigate Vytorin Marketing

Law360, New York (November 4, 2008, 12:00 AM EST) -- The U.S. Department of Justice, along with more than 35 state attorneys general, has begun investigations of Merck & Co. Inc. and Schering-Plough Corp. over their joint marketing for blockbuster cholesterol treatment Vytorin, Merck disclosed Monday.

Merck received a letter from the DOJ in September alerting the drugmaker that the government had opened inquiries into whether the two companies' promotion of the drug "caused false claims to be submitted to federal health care programs," according to the New Jersey manufacturer's quarterly filing with the U.S. Securities...
